4.1. Where the General Data Protection Regulation or a similar law applies to you, we rely on the following legal bases:

5.2. Chat and commands. Public, team and clan chat messages and the commands you run are stored against your account so that reports can be investigated and moderation decisions reviewed.
5.3. Gameplay recordings. A short recording of gameplay may be saved where our systems identify possible rule breaking, where a player files a report, or in connection with a clan war so that the result can be reviewed. Recordings are limited to the activity relevant to the matter being reviewed.
5.4. A recording may include your movement and actions, the actions of other players present at the time, and chat visible at the time. Recordings are accessible only to authorised staff, are not published, and are deleted automatically as set out in section 6.
5.5. Recordings and chat logs are not used for advertising and are not shared other than as described in section 7.

7.1. We share personal information only in the following circumstances:
7.2. Some information is public by its nature, including your username, rank, clan, statistics that appear on leaderboards, and anything you say in public chat. Please consider that before sharing personal details.
7.3. We do not sell personal information, and we have not sold personal information in the preceding twelve months.
8.1. We are established in the United States, and we operate servers in more than one region, currently including Asia and North America, so that players connect to a server near them. Your information is therefore stored and processed in the United States and in other countries, which may not provide the same level of data protection as your own.
8.2. Where we transfer personal information out of the European Economic Area or the United Kingdom, we rely on appropriate safeguards, such as standard contractual clauses with our providers, and we take reasonable steps to keep the information secure in transit and at rest.
9.1. We take the security of personal information seriously and apply technical and organisational measures appropriate to the risk. These include encryption of information in transit and of sensitive information at rest, controls that limit staff access to the information their role requires, logging of administrative access, and regular backups.
9.2. We do not publish the detail of our security arrangements, because publishing them would itself weaken them. If you are a security researcher and believe you have found a vulnerability, please report it privately using the contact details in section 15 and give us a reasonable opportunity to fix it before disclosing it publicly. We will not pursue action against researchers who act in good faith and do not access, alter or retain other people's data.
9.3. No system can be guaranteed to be completely secure. If a breach occurs that is likely to result in a risk to your rights and freedoms, we will notify the competent supervisory authority and, where required, the people affected, without undue delay.

10.2. To exercise a right, contact us at [email protected] from an address we can associate with your account, or contact us from the linked Discord account, and tell us your in game username. We may ask you for further information to verify your identity before we act, so that we do not disclose your data to someone else.
10.3. We will respond within one month. If a request is complex we may extend this by a further two months and will tell you if we do.
10.4. Limits on erasure. We may keep certain information after a deletion request where we have a lawful reason to do so, in particular a record of a ban and the identifiers needed to enforce it, records required by tax law, and information needed to establish or defend a legal claim. We will delete or anonymise everything else.
10.5. Exercising your rights is free of charge. We may charge a reasonable fee, or refuse to act, if a request is manifestly unfounded or excessive, and we will explain why.
10.6. If you are a resident of California, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives you the following rights in addition to those set out above:
10.7. The categories of personal information we collect are set out in the table in section 2, the purposes for which we use them are set out in section 3, the categories of recipients are set out in section 7, and our retention periods are set out in section 6.
10.8. We do not sell personal information, and we do not share personal information for cross context behavioural advertising, as those terms are defined by California law. We have not done so in the preceding twelve months, and we do not knowingly sell or share the personal information of anyone under 16 years of age.
10.9. We do not use or disclose sensitive personal information for any purpose other than those permitted without a right to limit under California law.
10.10. To exercise a California right, contact us using the details in section 15. You may use an authorised agent to make a request on your behalf, in which case we will ask for proof of the agent's authority and may ask you to verify your own identity directly.
11.1. The Service is not directed at children below the age of 13, or below the age of digital consent in your country if that age is higher.
11.2. We do not knowingly collect personal information from a child below that age. If we learn that we have, we will delete it as soon as reasonably possible.
11.3. A parent or guardian may contact us at any time to review, correct or delete the personal information of a child in their care, or to ask us to stop further collection. We will act on such a request after taking reasonable steps to verify the relationship.
12.1. Our websites use a small number of cookies and browser storage entries that are strictly necessary to provide the service you have asked for, including keeping you signed in, protecting against cross site request forgery, and remembering display preferences such as light or dark theme.
12.2. We do not use advertising cookies, and we do not use third party analytics that track you across other websites.
12.3. You can clear or block cookies through your browser settings. If you block strictly necessary cookies, you will not be able to sign in.
13.1. We use automated systems to help identify behaviour that breaches our rules. These systems may automatically restrict an account, for example by muting it or by flagging it for review by a moderator.
13.2. You have the right to ask for a human to review any automated decision that significantly affects you, to express your point of view, and to contest the decision. Use the appeals route described in our Terms of Service or contact us directly.
14.1. We may update this policy from time to time. We will publish the updated version on this page and change the "Last updated" date.
